Welcome to The Most Magical Book Club (“Book Club”), offered by Scribbly Inc. (“Scribbly,” “we,” “our,” or “us”). By enrolling in the Book Club, you (“Member,” “you,” or “your”) agree to these Terms of Service (“Terms”), which govern your membership, payments, shipments, and participation in the Book Club. Please read these Terms carefully.

1. Membership Benefits

As a Member of the Book Club, you will receive:

• Six (6) collectible Book Club books, each priced at $49.99 (a discount of $10 off retail).

• A custom membership card, included free in your first shipment.

• The annual limited-edition Book Club tote, included free in your first shipment.

• Optional add-ons, including but not limited to translations and custom dedications, available for an additional fee.

2. Payment Terms

• Per-Book Charges: Each book is billed individually at $49.99.

• Timing of Charges: Payment for each book (and any selected add-ons and shipping fees) is charged at the time Scribbly commences illustration production for that book.

• Additional Fees: Add-ons, such as translations or dedications, and shipping costs are charged along with the book payment.

• Taxes: Applicable sales taxes will be charged based on your shipping address.

3. Membership Duration & Commitment

• Term Start: Your Book Club membership begins on the date you enroll and continues for a period of twelve (12) months (“Membership Term”).

• Included Shipments: During the Membership Term, you will receive six (6) Book Club books, shipped in intervals throughout the year.

• Full-Year Obligation: By enrolling, you agree to purchase all six (6) books during the Membership Term. Membership is not month-to-month and cannot be paused or deferred.

4. Early Cancellation

• No Mid-Term Cancellations Without Fee: You may cancel your membership before the end of the Membership Term; however, doing so will incur a $100 early cancellation fee.

• How to Cancel: To cancel, you must either (a) log in to your Scribbly Books account and follow the cancellation process, or (b) contact our customer support team at contact@scribblybooks.com.

• Fee Payment: The early cancellation fee will be charged to your original payment method at the time of cancellation.

• Future Shipments: Upon cancellation and payment of the cancellation fee, no further books or add-ons will be shipped or billed for the remainder of the Membership Term.

5. Subscription Renewal & Cancellation

• Auto-Renewal: Memberships automatically renew for successive 12-month periods unless canceled.

• Reminders: We will provide reminder notifications prior to renewal.

• Opt-Out: You may disable auto-renewal at any time via your Scribbly account settings.

• Full-Term Obligation: All members are obligated to complete the 12-month membership period, regardless of when auto-renewal is disabled.

5. Shipping & Delivery

• Schedule: Books are delivered in intervals throughout the membership year. Exact delivery dates may vary based on production timelines.

• Delays: Scribbly is not liable for delays caused by carriers, customs, natural events, or other circumstances beyond our control.

• Shipping Fees: Members are responsible for all shipping fees, which are collected at the time of each book’s billing.

6. Refunds & Returns

• No Refunds: Payments for books, add-ons, shipping, and fees are non-refundable once charged.

• Defective Items: If your book or merchandise arrives damaged or defective, please contact us within 14 days of delivery for a replacement.

7. Account Responsibilities

You are responsible for maintaining accurate payment, shipping, and contact information in your Scribbly account. Scribbly is not responsible for shipments lost due to inaccurate information provided by you.

8. Termination

Scribbly reserves the right to suspend or terminate your membership for violation of these Terms, non-payment, or fraudulent activity.

9. Limitation of Liability

To the fullest extent permitted by law:

• Scribbly is not liable for any indirect, incidental, special, or consequential damages arising from your membership.

• Our maximum aggregate liability to you shall not exceed the total amount paid by you under your current 12-month membership.

10. Governing Law

These Terms are governed by and construed under the laws of the State of Texas, without regard to conflict of law principles.
